Procurement in the road sector. Features of forming contract prices for road works

On 24–25 July 2019, a scientific and practical seminar “Procurement in the road sector. Features of forming contract prices for road works” was held in Chernihiv.

The seminar was attended by specialists dealing with public procurement in regional road services, regional state administrations, regional road enterprises, and contracting organizations.

During the seminar, the Director of SE “DerzhdorNDI”, Artem Bezuglyi, reviewed the latest innovations in the Ukravtodor regulatory framework, including the presentation of the new classification of road works, amendments to DBN for road design and construction, as well as practical recommendations from Ukravtodor on procurement procedures for construction works and routine maintenance services for highways.

In addition, a number of current issues in the field of public procurement were discussed:

  • Draft Law of Ukraine “On Amendments to the Law of Ukraine ‘On Public Procurement’ and Certain Other Legislative Acts of Ukraine on Improving Public Procurement”;
  • Presentation of the analytical module of the “Transparent Infrastructure” portal;
  • Features of organizing and conducting procurement procedures, forming the annual procurement plan, and determining the subject of procurement;
  • Approaches to preparing tender documentation: qualification requirements for participants, documentary confirmation of compliance with qualification criteria considering the specifics of road repair and maintenance procurement, technical and quality specifications, involvement of subcontractors, evaluation criteria and methodology, and contract draft;
  • Practice of appealing customer decisions in the Antimonopoly Committee and discriminatory requirements;
  • Features of road works pricing. Overview of the latest changes in national and sectoral pricing standards. New procedure for calculating estimated wages. Problematic issues in determining the cost of road works;
  • Determining the expected cost of highway maintenance services;
  • Contract conclusion: verification of contract price after auction results, issues in contract execution under procurement procedures, changes to essential contract terms after signing, contract invalidation, and application of operational and economic sanctions;
  • Subthreshold procurement, negotiated procedure procurement, and procurement of additional works.
