FIDIC MEMORANDUM

“DerzhdorNDI” SE , the Association of Consulting Engineers of Ukraine (AECU) and the Georgian Association of Consulting Engineers (ACEG) have signed a memorandum of cooperation focusing on the implementation of infrastructure projects, reconstruction, repairing of infrastructure facilities involved by the DECREE OF THE PRESIDENT OF UKRAINE No.529 / 2019 “On some measures regarding ensuring conditions for the development and quality of roads”. This memorandum initiates the formation of roadmap for the introduction of best practices and standards for practical implementation of the above-mentioned Decree of the President of Ukraine. The focus of international cooperation is to increase organizational and financial efficiency in project implementation (construction, reconstruction, repairing of infrastructure facilities), increasing of traffic safety standards and the implementation of quality control system for infrastructure works based on the standards of International Federation Consulting Engineers (hereinafter - FIDIC).

ACEG and AECU will provide technical, advisory and other support on the following issues: Ensuring transparency and reasonableness of decision-making in the area of state planning of construction, reconstruction, repairing of roads by defining clear, understandable for people and business priorities, considering national interests and adequate resource provision.

Challenges of introduction of information system of planning processes automation, designing (at all stages), procurement, implementation, accounting, management of changes, commissioning and operation and maintenance of construction, reconstruction and current, overhaul and emergency repairs of road infrastructure facilities.

Development of changes to key program documents in the area of construction, reconstruction, repairing of roads in order to comply with clear and understandable priorities and national interests. Consideration of proposals for amendments to legislation directed on implementation in the framework of budget planning to determine the amount of financial support for construction, reconstruction, repairing of roads by the expense of budget funds for the long term.

Review of qualification criteria, financial and technical requirements for participants in public procurement in the area of construction, reconstruction, repairing of roads in accordance with the best world procurement practices used by international financial institutions. Ensuring conditions for the latest technologies and materials use in the area of construction, reconstruction, repairing of roads, revision of relevant regulatory and technical documents to ensure the European quality of roads, free access to the texts of such documents. Establishment of an obligation for customers of construction, reconstruction and repairing of roads to involve on a competitive basis an independent engineer-consultant in the area of road construction (FIDIC) at the stages of procurement, works performing, warranty service.

Transparency of planning, ordering, construction, reconstruction, repairing of roads and their warranty service, in particular the work over the issue of creating a public portal of management and monitoring system in real time of construction, reconstruction and repairing of roads. Inclusion of conditions on insurance of such objects in the contracts on performing of works on construction, reconstruction and repairing of roads.

Coordination of regional programs of road development with the relevant documents of state planning and consideration by local governments in the development of local program documents for the construction, reconstruction and repairing of roads of the relevant documents of state planning.
